Terms and Conditions
These terms and conditions govern all dealings between Arktos Media Ltd. (‘us’) and its customers and apply to all customers, including retail customers, bulk customers, distributors and libraries (unless otherwise stated herein or agreed). The provisions relating to Our Intellectual Property Rights, Privacy, Frustration and Jurisdiction apply to all dealings between Arktos Media Ltd. and any third parties.
Your privacy is important to us. We do not store credit card details nor do we share customer details with any 3rd parties.
Your order (and not the items on our web-site) constitutes an offer. Our confirmation of your order constitutes our acceptance of your offer. A contract between us and you is created when you receive the confirmation. Regarding orders not made through our web-site our contract comes into being once we have accepted your order, usually by email.
If one or more items ordered are not in stock at the time of your order the contract will be deemed to not include those items, but will still exist in relation to such items as are available, which we may ship to you provided we refund the part of the shipping charges relating to the unavailable items. We may (at our discretion) contact you for further instructions in such circumstances, in which case you will have the right to cancel or amend you order.
If the price of an item is different from the price displayed on our web-site we will charge the lower price (if the actual price is lower than the price on our web-site), or contact you for instructions (if the actual price is higher than the price on our web-site).
Once the items you have ordered have been entrusted with a reasonable shipper we have fulfilled our part of the contract and are not liable for any loss or damage during transit.
All our orders are shipped from the United Kingdom within 48 hours of receipt (possibly more if an order is received on a weekend or during a holiday period). We ship worldwide. Delivery times depend on the customer's location and chosen shipping method, although orders going to addresses in North America or Europe can generally expect to receive their orders within two weeks. Orders going to addresses in the United Kingdom will typically receive their orders sooner than that. Customers who do not receive their orders within two weeks should feel free to contact us
If you are a retail customer you may return any items purchased from us within fourteen days of receipt. We will refund your order within thirty days, provided the goods we receive from you are in the same condition as they were when we sent them to you. Such refund excludes the shipping and handling fee you initially paid for having the order dispatched to you, and you will have to pay the cost of sending it back to us. Please email us
if you wish to return an item, and we will send you further instructions.
If you wish to make a return because the goods you purchased are defective or otherwise of substandard quality then we give you the option of either having replacement goods sent to you or giving you a full refund, which includes the money you paid in postage and the money you spent sending the goods back to us. This, however, is on the condition that we, having received the defective goods, agree that they are indeed defective or below the standards a customer purchasing an item from us could reasonably expect. Generally we will give you refund if the items has some significant flaw, but not if the perceived defect is trifling.
If you are a retail customer residing within the European Community you have a statutory seven-day ‘cooling off period’ in addition to your fourteen-day right of return. This means you can return the goods within twenty-one days of receipt.
If you are a business customer you have no right of return, unless such a right has been expressly agreed to by us in writing (‘in writing’ includes e-mail). You are a ‘retail customer’ if you are considered a “consumer” under the Sale of Goods Act 1979, as amended. Otherwise you will be deemed to be a business customer.
Exclusion of liability
We shall not be liable in damages for any losses (whether direct or indirect, financial or otherwise) caused by late delivery, defective products or any other circumstance. (For the avoidance of doubt, you may have any defective products replaced as per the provisions concerning returns, above.)
If you make an order with us we will assume that you consent to receiving newsletters detailing Arktos news, additions to our catalogue, special offers and so forth. If at any time you request that we stop sending you newsletters we will remove your e-mail address from our newsletter list.
We have the exclusive right to the content of our web-site. Nothing found on our web-site may be used for such purposes as would be contrary to our copyright ownership, including copying as well as other illegitimate use of any items, descriptions, texts (other than book descriptions not covered by copyright), images, logos, trade names, and any other intellectual property on our web-site.
We reserve the right to amend these Terms & Conditions as we see fit and at any time.
We will not be liable for events beyond our control, such as, for example, delayed deliveries, strikes, mistakes made by the postal service, interference by customs, theft, or the like.
If we have a right to do something but do not make use of that right we shall not be deemed to have waived the said right.
These terms and conditions and all dealings between us and you shall be subject to the laws of England & Wales, unless otherwise agreed. Any disputes shall be decided by the Central London County Court or, if the matter in dispute falls outside its jurisdiction, the appropriate court nearest to it. Major disputes may (at our discretion) be conducted in Her Majesty’s High Court of Justice at the Strand in London. Minor disputes may (at our discretion) be conducted through www.moneyclaim.gov.uk.
